The Supreme Court, Albany County, Keegan, J., granted school’s motion for summary judgment. Student appealed. The Supreme Court, Appellate Division, Mikoll, J.P., held that: (1) nondegree granting business school was functional equivalent of college such that it was not a guarantor or insurer of safety of its students, and (2) school was not on notice of likelihood of dangerous conduct by other student.
